side note: This is not news to those in the know, but very few medical malpractice lawsuits actually result in a pay out. To the layperson, it can be easy to dismiss the necessity of tort reform legislation if only 20 percent of all malpractice lawsuits lead to a settlement or other payment. What the layperson fails to realize is that each claim that is filed requires hundreds of thousands of dollars to defend. The defense of claims has a much greater impact on the cost of medical malpractice insurance premiums than actual awards.

ATLANTA (AP) — Only 1 in 5 malpractice claims against doctors leads to a settlement or other payout, according to the most comprehensive study of these claims in two decades.
