The Wyoming Malpractice Landscape
Malpractice insurance rates in Wyoming are high, perhaps due to the fact that the state has not passed many meaningful reforms to its medical liability system. The market is strongly dominated by three carriers (UMIA, Mountain States Healthcare Reciprocal and The Doctors Company). Though there are several other carriers in the state, these top three companies control the majority of Wyoming premium.

Wyoming has not passed much in the way of meaningful medical liability reforms. The state constitution prohibits damage caps, and other common reforms such as collateral source usage and limits on attorney fees have not been instituted. Wyoming does allow healthcare providers to apologize for unanticipated outcomes and has also reformed its joint and several liability laws so that defendants are only liable for their portion of negligence. Wyoming also requires that medical malpractice cases be submitted to a pre-trial screening panel, which determines whether there is evidence that malpractice occurred. The panel’s decision is non-binding and can be bypassed if both parties in the case agree to it. The panel’s decision is admissible in any subsequent trial.
