When we first stared MyMedicalMalpracticeInsurance.com, it was with the intent of providing physicians with medical malpractice insurance for their practices and physician groups. Never in our wildest dreams could we have envisioned the explosion of medical spas over the last several years. This new breed of spa, with its combination of cosmetic and medical procedures, has its own unique insurance needs, and thus, medical spa liability coverage was born. Medical spa policies have become a significant part of our practice and a new specialty for us.

Medical spa liability policies cover medical spas and the aestheticians and physicians who provide services. Most states require medical spas to be licensed and to also have a Medical Director, who is usually a physician. (The job of Medical Director is usually a part-time position, that requires its own kind of liability insurance called Directors and Officers Insurance.) The individuals who operate the equipment and/or perform the procedures are usually required by the insurance companies to be trained and to provide proof of training. For example, many medical spa liability companies require laser operators to have at least 30 hours of training.

Many medical spa liability companies also require that spas supply their consent and aftercare forms. Many insurance companies are happy to provide medical spas with suggested forms-just ask.

A unique feature of some medical spas is that they offer off-site demonstrations of their products. This is a nice way to create alternative sources of income. These demonstrations are often of Botox or Juvederm and are sometimes referred to as “spa parties.” However, all medical spas should make sure that their medical spa policy covers off-site procedures. Most medical spa liability policies do, but not all of them –so ask your insurance agent.
