The Vermont Malpractice Landscape

Malpractice insurance rates in Vermont are moderate and have been fairly stable in recent years. The state has relatively few malpractice carriers, with the top two insurers (Medical Mutual of ME and ProSelect) covering more than 2/3 of the total premium available. However, other insurers have recently begun making some inroads. Vermont has passed little in the way of medical liability reform measures, but the state is known for having a low-level of lawsuits, so rates have remained moderate despite the lack of reform.

Tort Reform in Vermont

The Vermont legislature has not made significant reforms to the state’s medical liability system. The state does not have any damage caps, nor has it made reforms to joint and several liability, changed collateral source rules, or limited attorney fees. Vermont does have an arbitration system for medical malpractice cases, which is available if all parties agree to it. Despite the absence of reforms, Vermont’s tort system scored very high in the Institute for Legal Reform’s (an affiliate of the U.S. Chamber of Commerce) 2015 Lawsuit Climate Survey: Ranking the States: A Survey of the Fairness and Reasonableness of State Liability Systems, ranking second behind only Delaware.

Does Vermont have…
